fa حقوق اقلیت‌ها از سه منظر؛ اسناد بین‌المللی، اسلام و قانون اساسی ج.ا.ایران تخصصي Special پژوهشي Research <p dir="RTL" style="margin-right: -3.7pt text-align: justify">اصطلاح اقلیت از نظر حقوقی شامل آن دسته از گروه‌های انسانی است که معمولاً از جهت حقوقی، سیاسی، فرهنگی و اقتصادی در موقعیت و شرایط حاشیه‌ای قرار دارند. امروزه با توجه به اهمیت بین‌المللی اقلیت‌ها، این موضوع به‌عنوان یک موضوع جهانی و مسئله‌ای برای بسیاری از دولت‌ها مطرح است. ایران دارای اقلیت‌های گوناگون مذهبی، قومی و زبانی است. این اقلیت‌ها در همه دوره‌های تاریخی ایران به دنبال مطالبات حقوقی، سیاسی، اجتماعی و فرهنگی خود بوده‌اند. این پژوهش به دنبال نشان دادن آن است که در سه دهه اخیر اقلیت‌های مذهبی در جمهوری اسلامی ایران از طریق قانون اساسی و فتاوی فقها، به بخش زیادی از حقوق برابر نسبت به ایرانیان مسلمان دست یافته‌اند؛ اگرچه به نظر می‌رسد تا تحقق حقوق برابر با مسلمانان، با توجه به پاره‌ای محدودیت‌های قانونی و برخی اختلاف دیدگاه‌ها، فاصله نسبتاً زیادی وجود دارد. در دوره اخیر، این مهم توسط نهادهای حقوقی و سازمان‌های ذیربط مورد توجه و تأکید بیشتری قرار گرفته است و اقلیت‌ها در جمهوری اسلامی ایران در زمینه برخورداری از حقوق قانونی خود، از موقعیت مطلوب‌تری نسبت به بسیاری از کشورهای دیگر برخوردارند.</p> <p style="text-align: justify">The term minority is legally refers to those human groups which usually<br> are marginalized legally, politically, culturally and economically.<br> Nowadays, regarding the international importance of minorities, this is<br> a global issue and a problem for many of the states. Iran is of different<br> religious, ethnic and linguistic minorities. These minorities looked<br> for their legal, political, social and cultural receivables. This survey is<br> going to show that religious minorities in the Islamic Republic of Iran<br> have attained most of the equal rights with Muslim Iranians via the<br> constitution and the verdicts of jurists, during the last three decades,<br> although, considering some legal restrictions and different views, it is<br> a long way to the substantiation of equal rights with Muslims.
